What Happens to an Annuity When the Owner Dies?

Beneficiary instructions are part of the investment decision.

The executive brief

Annuity inheritance depends on the contract, whether it is qualified or nonqualified, who owns it, and who is named as beneficiary.

Owner, annuitant, beneficiary

These roles are not always interchangeable. The owner controls the contract; the annuitant may determine payout terms; the beneficiary receives applicable death benefits. Contract definitions govern.

Qualified versus nonqualified taxation

An IRA-funded annuity generally follows inherited IRA tax rules. In a nonqualified annuity, gain above investment in the contract is generally taxable as ordinary income when distributed.

Spouses and nonspouses differ

A surviving spouse may have continuation options unavailable to other beneficiaries. Nonspouse options and required distribution timing vary by contract and applicable tax rules.

Review the beneficiary form

Outdated designations can override expectations. Coordinate primary and contingent beneficiaries with trusts, estate documents, and family circumstances, and request written confirmation.

Your next wealth decision

Ask the carrier for a contract-specific beneficiary options summary; do not assume an annuity transfers like a brokerage account.

What to do next

Request written explanations of fees, restrictions, assumptions and alternatives. Consider the strategy in the context of your entire financial life, and review it with appropriately qualified professionals.
